Welcome to Tonka Tides. These Terms of Service ("Terms") govern your access to and use of tonkatides.com (the "Site") and any products purchased through it (the "Products"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you don't agree, please don't use the Site.

1. Who We Are

Tonka Tides is an apparel brand based in Minnesota. Throughout the Site, the terms "we," "us," and "our" refer to Tonka Tides. These Terms apply to all users of the Site, including without limitation browsers, customers, and merchants.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order on this Site. By using the Site, you represent that you meet this requirement.

3. Products and Pricing

All Products are subject to availability. We reserve the right to limit quantities, discontinue a Product, or refuse any order at our discretion.

Prices for Products are subject to change without notice. We reserve the right to modify or discontinue pricing at any time.

We've made every effort to display our Product colors and details as accurately as possible. We can't guarantee your device's display will be perfectly accurate.

In the event a Product is listed at an incorrect price due to a typographical, pricing, or technical error, we reserve the right to cancel any orders placed for that Product, whether or not the order has been confirmed.

4. Orders and Payment

By placing an order, you're making an offer to purchase the Product(s) in your cart. We reserve the right to accept or decline your order for any reason, including suspected fraud or unauthorized activity.

Payment is processed at the time of order through our third-party payment processor(s). By submitting payment information, you represent that you're authorized to use the payment method provided.

You agree to provide current, complete, and accurate purchase and account information for all purchases made on the Site.

5. Sales Tax

Tonka Tides currently sells clothing items, which are exempt from sales tax in Minnesota. Sales tax may apply to future non-apparel product categories or to shipments outside Minnesota, depending on applicable state law. Any applicable tax will be calculated and displayed at checkout.

6. Shipping

Shipping timelines and costs are provided at checkout and are estimates only. We are not responsible for carrier delays.

Risk of loss and title for Products purchased pass to you upon delivery to the shipping carrier.

You are responsible for providing accurate shipping information. We are not responsible for orders delayed or lost due to incorrect address information provided at checkout.

7. Returns and Exchanges

Returns must be requested within 30 days of the item being delivered. This window is extended to account for weekends or holidays where applicable.

Return shipping is the customer's responsibility. We do not provide prepaid return labels.

We do not charge a restocking fee on returns.

Final sale items are not eligible for return or cancellation. Any Product marked as final sale at checkout is excluded from the return policy above.

Order cancellations may be requested any time before your order has been fulfilled. Once an order has shipped, it is no longer eligible for cancellation and falls under the return policy above instead.

Returns and cancellations apply only to items purchased after these policies were put into effect; they do not apply retroactively to prior orders.

8. Intellectual Property

All content on this Site, including but not limited to the Tonka Tides name, logo, burgee/pennant graphic, product names, graphics, text, and images, is the property of Tonka Tides and protected by applicable copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from this content without our prior written consent.

9. User Conduct

You agree not to use the Site to:

Violate any applicable law or regulation

Infringe upon the intellectual property rights of Tonka Tides or any third party

Transmit any harmful code, malware, or unauthorized advertising

Attempt to gain unauthorized access to the Site, our systems, or other users' accounts

Engage in any conduct that restricts or inhibits anyone's use of the Site

10. Third-Party Links and Services

The Site may contain links to third-party websites or services that are not owned or controlled by Tonka Tides. We are not responsible for the content, policies, or practices of any third-party sites.

11. Disclaimer of Warranties

The Site and all Products are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except as required by applicable law.

12. Limitation of Liability

To the fullest extent permitted by law, Tonka Tides shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or Products, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your purchase shall not exceed the amount you paid for the Product(s) giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Tonka Tides, its owners, employees, and affiliates from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

14. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to the Site with an updated "Last Updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Minnesota.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
